Welcome, Qggl user! In these Terms of Service (these “Terms”), we’re going to use “we”, “us” and “our” to refer to Qggl, Inc., “Qggl” to refer to the services we provide and “you” and “your” to refer to you, the person using Qggl.
These Terms apply to the family of link redirection and link-related social media websites owned and operated by Qggl, Inc. (in some cases under a license from Qggl Limited). These include our main website, http://qggl.co, as well as http://qggl.it, http://qwik.it, http://hdln.it, http://tggl.it, http://tggl.me, http://defn.me, http://gtmnd.com, http://qpic.it and http://qtube.it.
These Terms do not apply to third party websites that we or our users link to -- as you’ll quickly notice when you use Qggl, our users can link to strange, interesting, boring or even terrible things on the Internet, none of which we have any control over.
In the course of using Qggl, you’ll inevitably create new copyrighted works, and you might also share pre-existing copyrighted works with us (your “Content”). Content includes the links that you create, information you add to your profile, comments you make and other materials you post through our social media features. Content does not include any information we automatically gather or generate in connection with your use of Qggl (such as metrics about your use, the headers your browser sends, statistics about how you use Qggl features, etc.) and you agree that all such information is our property.
As between us, you retain full ownership of your Content (if it wasn’t yours to begin with, we can’t help you there). You grant us and all users of Qggl a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license to use, reproduce, perform, display, distribute, create derivative works from and otherwise fully exploit your Content in delivering, receiving, promoting, discussing or commenting on any current or future Qggl services or similar services operated by a successor to Qggl, in any medium or channel. All delivery of your Content through the Qggl service will be subject to the privacy settings and permissions that you’ve configured with respect to particular Content or certain types of Content.
On deletion of your account from Qggl, we will remove your profile and the Content connected solely to your profile. We will not remove link pages for links that you coined or promoted (but may, in our discretion, remove you from the precedence list for those links), and we will not remove social media comments in public discussion threads (but may, in our discretion, de-identify those comments or replace your name with a system-generated pseudonym).
The Qggl service incorporates and uses a combination of our intellectual property and the intellectual property of other people (including copyrights, trademarks and patents). We grant you a license to use that intellectual property for the sole purpose of using Qggl in an authorized manner.
In addition to specific policies and requirements elsewhere in these Terms, you are not authorized to use Qggl for the following purposes:

The Qggl service is provided “as is” and at no cost to you. We don’t provide any warranty of any kind, express or implied. In particular we don’t promise:
Also, we certainly hope you’re not trying to rely on Qggl in any way or use Qggl commercially, because we don’t warrant that it meets even the minimal standards for this type of service (even though we think it’s pretty cool when it’s working).
In particular, to the extent that the version of the Qggl service you’re using is labeled as “alpha” or “beta”, it’s particularly likely to behave incorrectly and unpredictably.
Because anyone with an email address can sign up for Qggl, we can’t promise that we’ll be able to keep bad actors from participating in the Qggl service. We also have no control over what Qggl links point to, because they’re created by our users and then interpreted by the target service. In addition to the cool and funny stuff we hope people will focus on, you may very well encounter degrading, upsetting, offensive, indecent, racist and disgusting content at the other end of a Qggl link — accordingly, you use Qggl at your own risk.
If anyone sues or takes other legal action against Qggl, Inc., Qggl Limited or any of their respective directors, employees, contractors, agents, partners or suppliers based on a claim related in any way to:
you agree to pay all of the costs incurred in defending, settling or paying judgments related to such a Claim, including reasonable attorneys’ fees.
In exchange for our providing this service at no cost to you, you agree that Qggl, Inc., Qggl Limited and their respective directors, employees, contractors, agents, partners or suppliers shall not be liable to you:
To the extent that the laws of your state do not permit this limitation of liability, then such damages shall be excluded to the maximum extent permitted by law.
These Terms shall be governed by the laws of the State of New York, and any dispute or claim may only be brought in an appropriate court located in New York County, New York, and both you and Qggl agree to submit to the jurisdiction of the courts in New York County, New York.
Children under the age of 13 may not use Qggl, and we will terminate any account if we learn that it was created or is maintained by someone under the age of 13.
It’s a violation of Qggl policy for users to create links with the intention of referring to material that infringes the intellectual property rights of others. However, Qggl links only operate by searching the content of large, reputable services (such as Google, Twitter and Wikipedia), which in turn provide the search results or redirection to particular content. As a practical matter, copyright owners who are upset about how a Qggl link is being resolved will be much better served by contacting the applicable service targeted by that link rather than us.
That said, we’ve registered as an online service provider with the United States Copyright Office pursuant to the Digital Millennium Copyright Act (the “DMCA”) and we claim protection under its safe harbor provision. This applies to both Qggl links and to any user-generated Content on our site.

If you are a registered user and have provided us with a valid email address, we will use that address to let you know about changes to these Terms. We will also place notices on our the Qggl sites for a reasonable period of time following a material change to these Terms. However, it is ultimately your responsibility to review these Terms from time to time and to comply with them when you use Qggl.
